        <description>June 14, 2013 But Supremes bash back with new set of &amp;#39;regulations&amp;#39; A federal judge has blasted the Supreme Court&amp;rsquo;s plaza policy, which forbids people from being in &amp;ldquo;assemblages&amp;rdquo; or carrying signs that are intended to attract attention, declaring such limits in the shadow of the building where the First Amendment is supposed to be protected unconstitutional. With hours, the Supremes bashed back, installing a new set of restrictive &amp;ldquo;regulations&amp;rdquo; specifying what can and cannot happen on the high court property including the plaza. It was Judge Beryl Howell who wrote in an opinion this week that such limits &amp;ndash; outlined in federal law and based on the &amp;ldquo;dignity&amp;rdquo; of the location &amp;ndash; are unconstitutional and unenforceable. &amp;ldquo;The absolute prohibition of expressive activity in the statute is unreasonable, substantially overbroad, and irreconcilable with the First Amendment,&amp;rdquo; the judge wrote. &amp;ldquo;The court therefore must find the statute unconstitutional and void as applied to the Supreme Court plaza.</description>

In responding to a reporter&amp;#39;s question about so-called &amp;quot;media shield legislation&amp;quot; under consideration in Congress following the disclosure that the Obama Justice Department improperly obtained telephone records of Associated Press and Fox News reporters and editors, Graham had this to say: &amp;quot;&amp;#39;Who is a journalist&amp;#39; is a question we need to ask ourselves. Is any blogger out there saying anything - do they deserve First Amendment protection? These are the issues of our times.&amp;quot; &amp;nbsp; &amp;#39;Are you planning to fire Holder?&amp;#39; The &amp;quot;issues of our times?&amp;quot; Since when has the First Amendment been subject to congressional approval, senator? Then again, this whole thing begs the larger question: Why the need for a &amp;quot;media shield law&amp;quot; at all, given that the First Amendment already guarantees freedom of the press? The National Journal had this to say on Graham&amp;#39;s &amp;quot;riffing&amp;quot; on the Bill of Rights: Graham&amp;#39;s riffing on constitutional law exposes one of the age-old tensions between journalism as a product and journalism as an activity.</description>
