SUMMARY-WAR AND EMERGENCY POWERS: SPECIAL REPORT ON THE NATIONAL EMERGENCY IN AMERICA
o If we in the US are indeed still under war emergency, this should be reflected in existing federal law. Evidence of this is found in the United States Code, 12 USC, Section 95 (b), which states:
"The actions, regulations, rules, licenses, orders and proclamations heretofore or hereafter taken, promulgated, made or issued by the President of the United States or the Secretary of the Treasury since March the 4th, 1933, pursuant to the authority conferred by Subsection (b) of Section 5 of the Act of October 6, 1917, as amended [12 USC 95 (a)], are hereby approved and confirmed. (March 9, 1933, c.1, Title 1, 48 Stat.1.)"
This is exactly the same wording found in the National Emergency Act of March 9, 1933, Chapter 1, Title 1, under the "Rule of Necessity".
This means that anything that the US President or Secretary of the Treasury does is already approved. It means that Congress has permanently delegated its power as the representative legislative body of the people to the executive branch, as have the federal courts.
It also means that we the people of the United States are therefore -- despite the carefully staged appearance of democratic process in our government -- have been living under a constitutional dictatorship since 1933.
o This was done by changing one phrase in a law passed by Congress in 1917, at the beginning of US entry into World War I:
On October 6, 1917, the US Congress passed the Trading with the Enemy Act, empowering the federal government to take control over any commercial, monetary or business transactions conducted by enemies, or allies of enemies, within our continental borders. That act also defined the term, "enemy" and excluded from that definition the people of the United States. But on March 9, 1933, Section 2 of this federal act was amended to state "by any person within the Unites States or anyplace subject to the jurisdiction thereof." This amended provision thereby defines the "enemy" as being the people of the United States.
This definition tacitly and legally persists, and explains how and why, despite the existence of the US Constitution and US Bill of Rights, the federal government behaves as if the American people, now essentially defined as "enemy combatants" have no rights at all: if we the sovereign people are now defined as "enemy combatants", then our surrogate federal goverment needs to be in a permanent state of war to defend the authority that it has fraudulently usurped by means of statutory law.
o Since, according to Article 5 of the US Constitution, the federal government may not maintain a standing army except in time of war, but may maintain a navy at all times, the federal courts have been put tacitly under admiralty law as permanent military tribunals, in which the US Constitution and Bill of Rights have no authority.
Further, the federal government, besides instituting
the abovecited statutory laws, has sought to maintain a constant state of war by engaging in numerous foreign wars of empire fraudulently represented to the public as peacekeeping interventions or defensive operations
since 1917, and by converting the entire US economic base into one of corporatized military finance and manufacturing, with heavy cultural indoctrination through the mass communications media and
educational system to reinforce this.
o Since the sovereign American people essentially have been declared "enemy combatants" by the surrogate federal government, they are now obligated to obtain licenses for all commercial, monetary or business transactions, and many federal agencies, ostensibly temporarily created during the state of emergency in 1933, now are permanent and heavily regulate every aspect of our national life.
o Senate Document No. 43 of 1933 and the United States vs. Russell decision of 1871 both set precedents by stating, respectively, that private property is ultimately subject to state approval and disposal, and that private property may be seized without the owner's consent during time of war, despite the Fourth Amendment of the US Constition, which only applies during peace time.
o In March 1933, the Federal Reserve Board of New York passed a resolution stating that the desire of depositors to redeem their monetary deposits for gold for purposes of "hoarding" was creating a national emergency, implying that this should be forbidden by the federal government, and that a bank holiday should be declared on March 4 and March 6, 1933. This President Herbert Hoover declined to do, deeming it extreme and unnecessary; soon after he was seemingly soundly defeated in the national election of November 1932
However, on March 9, 1933, the newly elected president Franklin D. Roosevelt did comply with the Federal Reserve resolution, declaring a two-day bank holiday and a national state of emergency that should last as long as it was not rescinded by him or any other US president, as well as automatic approval for anything that the President of the United States or the Secretary of the Treasury should declare. This national emergency, together with its imperial executive powers, has to the present day never been rescinded.
o The US Congress approved this resolution, and the Emergency Banking Relief Act, in which they permanently delegated their power to the federal executive branch and gave control of all American banks to the US Treasury, with no copies having been made available for members of Congress to review beforehand, resembling the same tactics used in gaining approval for such alleged emergency legislation as the USA PATRIOT Act in 2001.
o During this presidentially declared two-day bank holiday, during which the dollar was also devalued, much of the gold and actual wealth of the American people was transferred into foreign banks, with it no more available to its depositors. Under this emergency declaration, depositors could be heavily fined and imprisoned if they questioned the Federal Reserve concerning the disposition of their funds. They were also ordered to turn in all of their gold to the federal government, under penalty of law. The US government then began issuing, under authority of the US Treasury, Federal Reserve bank notes, serving as debt notices using the American people and their private property as collateral for national debt security in their function as taxpayers in thrall to the privately owned Federal Reserve corporation.
o Since the entire US banking system remains under the US Treasury with powers conferred by Roosevelt's emergency declaration and the Emergency Banking Relief Act of 1933, this is yet another indication that the US remains in a permanent state of emergency conferring dictatorial powers on the President of the United States and the US federal corporate government.
o The Agricultural Adjustment Act, also called the Emergency Farm Mortgage Act of 1933, was used to extend the power of the President of the United States, the US Secretary of the Treasury and the Federal Reserve, which is, as previously mentioned, controlled by a private international banking cartel. It allowed a vast extension of credit to the US Treasury and the Federal Reserve, and tacitly nationalized American agriculture and US land, paving the way for corporate control of the US food supply that now exists, especially since the recent passage of the so-called Food Safety Act of 2010.
o The US Congress has, with the Emergency Declaration of 1933, signed away its powers to rescind this permanent state of emergency, allowing constitutional dictatorship over this nation. The jurisdiction of the federal courts is determined by Congress; they will not decide so political a question as whether such a state of war should so long exist without explicit mandate from Congress to do so.
Therefore, the termination of the present permanent state of emergency in America can only be effected by the President of the United States rescinding it, which none since 1933 have been inclined to do -- or by the sovereign American people standing up together to challenge the surrogate corporate federal government and demand that this rescission immediately be done, being willing thereby to transform many aspects of themselves and of their national life to reflect authentic truth, freedom, justice and peace that have for all too long been absent from our country.
